Public Hearing - Conditional Use Permit Request C11-04, submitted by E. Grier Ferguson of Ferguson, Rawles & Raines, P.C. on behalf of Angus I. Hines, Inc., property owner, to permit replacing a nonconforming structure (gas island canopy) that was damaged by more than 50% of the replacement costs in accordance with Sections 31-306 and 31-801 of the Unified Development Ordinance 24. Public Hearing - Conditional Use Permit Request C-14-04 for Casual Fun Products, Inc., to operate an adult use retail business (adult bookstore) at the Suffolk West Shopping Center, Unit 7, 831 West Constance Road 25. Public Hearing - Rezoning Request RZ3-03 (Conditional), submitted by Whitney G. Saunders of Saunders, Babineau and Brewbaker on behalf of Suffolk Towers, L.L.C. and Bridgeway L.P., property owners, for a change in zoning from M1, Light Industrial District to RL, Residential Low Density District for 92.28 acres, RU, Residential Urban District for 33.45 acres and OI, Office Institutional District for 38.09 acres within a proposed Planned Development Overlay District (Conditional) on the west side of Harbour View Boulevard. In addition, the applicant is requesting a change in zoning from M1 , Light Industrial District to OI, Office Institutional District for 70.91 acres on the east side of Harbour View Boulevard. The applicant is also requesting that the Riverfront Residential Master Plan be amended to change the designated land use for Section EE from 63 single family attached to single family detached units 26. Public Hearing - Rezoning Request RZ4-03, submitted by Whitney G. Saunders of Saunders, Babineau, and Brewbaker, LLC. On behalf of Harbourview Partners, property owner, for a change in zoning from M1, Light Industrial District to OI, Office Institutional District for 37.91 acres, for property located at the northeast corner intersection of Harbour View Boulevard and Town Point Road 27. Public Hearing - A resolution declaring that a public necessity exists for the construction, operation, and maintenance of water transmission and distribution mains and a sanitary sewer force main and for municipal purposes generally, in and on certain real estate owned by: Trudy Eaver Norfleet, Arlene S. Smith, Morris A. Brinkley & Betty H. Brinkley, Gordon E. Vanderburg & Kerri L. Vanderburg, and William E. Edwards, Sr. & Paula J. Edwards; to authorize the taking of a portion of said real estates by condemnation 28. Ordinance - Subdivision Variance Request V1-04, submitted by Issam H. Baraki of Improvement Associates, Inc. on behalf of Classic Homes Development, Inc., property owner, for a variance from Section 31-612(f) of the Unified Development Ordinance to provide for the required connectivity ratio (This item was continued from the April 21, 2004, City Council Meeting) 29. Ordinance - Ordinance Text Amendment OA2-04, initiated by the Suffolk Planning Commission for an amendment to Chapter 31, Table 407-1, Unified Development Ordinance, to eliminate the minimum lot size and to increase the maximum density in the CBD, Central Business District 30. Motion - A motion to schedule a Re-organizational Meeting for July 1, 2004, at 11:00 a.m., in the City Council Chambers and to cancel the July 7, 2004, Meeting of City Council 31. Motion - A motion to schedule a Work Session for July 21, 2004, at 4:00 p.m., unless canceled. 32.
