Wetlands and navigable waters within the Commonwealth are regulated at various levels. Federal laws and regulations include the Clean Water Act and the River and Harbors Act which are overseen by the U.S. Army Corps of Engineers and the Department of Environmental Quality. At the state level the DEQ regulates under the State Water Control Law (
Chapter 3.1 of Title 62.1), and at the local level the applicable laws and regulations are the Chesapeake Bay Preservation Act and the Tidal Wetlands Act (
Chapters 13 and
Chapter 12 of Title 28.2) which are overseen by the Virginia Marine Resource Commission and local Wetlands Boards.
